Terms and Conditions

These terms apply when you enquire about or book private programming classes through this website.

1. Service provider

These Terms and Conditions apply to private programming classes offered by André Dias ("the tutor", "we", "us") through the website learn.diasandnights.com ("the website"). By using the website or booking a class, you agree to these terms.

2. Scope of services

  • Private one-to-one online programming classes covering Python, Django, Django REST Framework, and programming fundamentals.
  • Classes are conducted live via video call with screen sharing.
  • Teaching is personalised — there is no fixed syllabus. Content adapts to your goals and pace.
  • Classes are available in English, Spanish, and Portuguese.

3. Enquiry vs confirmed booking

  • Submitting the enquiry form does not create a confirmed booking. It starts a conversation.
  • The first introductory call (approximately 20 minutes) is free and without obligation.
  • A class or package is only confirmed after mutual agreement and payment.

4. Student eligibility

  • Classes are open to adults and, with parent/guardian involvement, to younger learners.
  • The enquiry form should not be submitted by a minor without parent/guardian authorisation.
  • No prior programming experience is required for beginner-level classes.
  • Intermediate and advanced classes assume the agreed prerequisite knowledge.

5. Scheduling and availability

  • Classes are scheduled by mutual agreement after the introductory call.
  • There are no fixed weekly commitments unless explicitly agreed.
  • Scheduling is flexible — sessions can be booked individually or in packages.
  • The tutor will propose available time slots. You may accept or suggest alternatives.

6. Prices and payment

  • Prices are displayed on the website and confirmed before booking.
  • Payment is required before the scheduled session.
  • Accepted payment methods will be communicated during the booking process.
  • Prices may be updated. You will always be informed of the current price before confirming a booking.

7. Class packages

  • Classes can be purchased individually or in discounted multi-session packages.
  • Package discounts and validity periods are shown on the pricing section.
  • Packages are personal and non-transferable.
  • Unused sessions in a package remain valid for the period stated at purchase.

8. Rescheduling and cancellations

  • Please provide at least 24 hours notice for rescheduling or cancellation.
  • Sessions cancelled with sufficient notice can be rescheduled without penalty.
  • Late cancellations (less than 24 hours) or no-shows may be counted as a used session.
  • If the tutor needs to cancel, you will be offered an alternative time or the session will not be counted.
  • Repeated late cancellations may affect future scheduling availability.

9. Refunds

  • Single class: if cancelled with at least 24 hours notice, a full refund is offered.
  • Class packages: unused sessions can be refunded on a pro-rata basis. Used sessions are charged at the single-class rate.
  • If you are unsatisfied after your first paid session, please contact us — we will work to resolve it.
  • Refunds are processed using the original payment method where possible.

10. Student responsibilities

  • Arrive on time for scheduled sessions.
  • Ensure a stable internet connection and a quiet environment.
  • Complete any agreed practice exercises between sessions.
  • Communicate openly about your goals, difficulties, and preferences.
  • Treat the tutor with respect. Abusive or inappropriate behaviour will result in termination of classes without refund.

11. Intellectual property

  • Code and materials you create during classes belong to you.
  • Teaching materials, exercises, examples, and explanations provided by the tutor remain the tutor's intellectual property.
  • You may use the teaching materials for your personal learning.
  • You may not redistribute, resell, or publish the teaching materials without written permission.

12. Technical requirements

  • You need a computer with a stable internet connection.
  • A modern web browser and a working microphone are required. A webcam is recommended.
  • Video calls use standard platforms (details provided when scheduling).
  • The tutor is not responsible for technical issues on your side.

13. Limitation of liability

  • The tutor provides classes to the best of their ability. No specific outcome, grade, job, or certification is guaranteed.
  • The tutor is not liable for indirect or consequential losses.
  • Nothing in these terms excludes liability that cannot be excluded by applicable law.
  • Your statutory consumer rights are not affected.

14. Governing law and changes

  • These terms are governed by the laws of the country where the tutor is established.
  • Any disputes will be subject to the jurisdiction of the courts of that country.
  • We may update these terms from time to time. The current version is always available on this page.
  • Continued use of the website or booking of classes after changes constitutes acceptance of the updated terms.
